Arnaud Gallais, in your petition put online on Thursday, December 8, you denounce “the trivialization and apology of incest and pedocrime organized by the cartoonist of comics Bastien Vivès through his works and his dangerous remarks” and this, even though it is illegal. What does the law say about this?
Since the Camille Kouchner affair and the #MeTooIncest movement that followed, the legislation on incest has progressed with the law of April 21, 2021 which specifies that when an aggressor of a minor is of legal age, coercion, threat, violence or surprise no longer need to be demonstrated. Article 227-23 of the Penal Code also specifies that in France, since 1998, any representation of a pornographic nature of minors is prohibited (and their mere possession of the image since 2002). In addition, “the fact, with a view to its dissemination, of fixing, recording or transmitting the image or representation of a minor when this image or this representation is pornographic in nature is punishable by five years’ imprisonment and a fine of 75,000 euros”.
In other words, drawing a child in a pornographic scene is prohibited by law. However, Bastien Vivès has produced at least three works classified in pornographic collections featuring children…
This makes him and his publishers repeat offenders. Having consulted all the plates of these three works, I can assure you that we are very far from the register ”
